1. Acceptance of Terms

By accessing or using Kaiju Email Verifier ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must discontinue use immediately.

2. Service Description

Kaiju Email Verifier is an email validation tool operated by Central (CIF: 74657091B). The Service performs syntax validation, DNS/MX checks, SMTP verification, and filters disposable/toxic domains. The Service is currently in beta and is provided free of charge.

3. Accuracy Disclaimer (CRITICAL - READ CAREFULLY)

3.1. No Guarantee of 100% Accuracy:
Email verification is a complex technical process that relies on real-time queries to external mail servers. While we strive for 99% accuracy, we cannot and do not guarantee 100% accuracy due to factors beyond our control, including but not limited to:

False positives/negatives from recipient mail servers
Greylisting policies that temporarily reject verification attempts
Catch-all domains that accept emails to any address
Changes in email status immediately after verification
Server outages or rate limiting by third-party mail providers
Spam filters or security policies that block verification

3.2. Results Are Estimates: Verification results should be treated as probabilistic estimates, not absolute guarantees. An email marked "Valid" may still bounce, and an email marked "Invalid" may occasionally deliver.

4. Limitation of Liability (ESSENTIAL)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CENTRAL SHALL NOT BE LIABLE FOR:

Email bounces even if marked as "Valid"
ESP account suspensions by Mailchimp, AWS SES, SendGrid, or any other service
Lost profits or business interruption
Data loss or corruption (although we process in-memory only)
Reputation damage to your sender score or domain
Any damages arising from the use or inability to use the Service

The Service is provided "AS IS" without warranties of any kind, express or implied. You use the Service entirely at your own risk.

5. Prohibited Uses

You agree NOT to use the Service for:

Sending SPAM or unsolicited bulk emails
Verifying email lists obtained illegally or without consent
Any activity that violates GDPR, CAN-SPAM, or other data protection laws
Attempting to reverse engineer, hack, or abuse the Service
Reselling or redistributing verification results without authorization

Violating this section will result in immediate account termination without refund.

6. Pricing & Refunds

6.1. Beta Period: The Service is currently free and unlimited during beta.

6.2. Post-Beta Pricing: After beta, the Service will transition to:
• Unlimited Plan: $57/month (unlimited verifications + full API access)
• We will provide 30 days notice before implementing any charges

6.3. No Refunds: All payments are non-refundable. We do not provide refunds for dissatisfaction with verification results, as accuracy is inherently probabilistic and depends on factors beyond our control.

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We reserve the right to suspend the Service for maintenance, updates, or any other reason without prior notice. Central is not liable for any downtime or service interruptions.

8. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or refund, for any reason including but not limited to violation of these Terms, suspected fraud, or abusive behavior.

9. Indemnification

You agree to indemnify and hold harmless Central, its owners, and employees from any claims, damages, or expenses (including legal fees) arising from your misuse of the Service, violation of these Terms, or violation of any laws or third-party rights.

10. Data Privacy

We operate a strict Zero Retention Policy. Email lists are processed entirely in-memory and deleted immediately after download. See our Privacy Policy for details.

11. Governing Law

These Terms are governed by Spanish law. Any disputes shall be resolved in the courts of Andalucia, España. By using the Service, you waive any objection to jurisdiction in these courts.

12. Changes to Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance. We will notify users of material changes via email or a prominent notice on the website.
